Gameable Terms of Service
Last updated: October 19, 2026
Gameable is operated by AvatarOS Inc., a Delaware corporation ("Gameable," "we," "us" or "our"). These Terms of Service ("Terms") govern Gameable.com and our related websites, accounts, creation tools, hosted characters and games, and any downloads, plugins, APIs or integrations we make available (together, the "Service"). Contact us at contact@gameable.com.
By accepting these Terms through a signup or other acceptance flow, you agree to them. If you use the Service on behalf of an organization, you confirm that you have authority to bind it, and "you" includes that organization. Do not create an account or use account-based features if you do not agree to these Terms. Our Privacy Policy explains how we handle personal information. Acknowledging that policy does not give us blanket consent for optional marketing, training or other processing that requires separate consent.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter into these Terms to create an account or use our creation tools and other account-based features. We do not offer accounts for minors or permit a parent to register an account for a minor to use. Signing up for email notifications does not create an account and is open to anyone 13 or older; we do not knowingly collect contact details from children under 13. Reading our public pages requires no account and no age confirmation. If we learn that an account does not meet these requirements, we may restrict it and take appropriate action, including deletion as required by law.
Provide accurate account information, keep your credentials and API keys secure, and notify us promptly if you suspect unauthorized access. Do not share a personal account, transfer it without our permission, or use another person's account. You are responsible for activity you authorize through your account. We may request reasonable information to verify eligibility, permissions or account security.
2. Waitlists, notifications and upcoming features
You may sign up for notifications about Gameable or selected features, including Unreal Engine plugins, digital content creation (DCC) integrations and character exports. We will use your contact information to send the notifications you request, as described at signup and in our Privacy Policy. You can unsubscribe using the link in our emails or by contacting us. Optional broader marketing subscriptions are separate from account access and required service notices.
A notification signup or waitlist entry does not create a paid subscription, reserve a particular place, guarantee an invitation or entitle you to a feature. Unless we expressly agree otherwise in writing, demos, previews, roadmaps and estimated dates describe work in progress, not delivery commitments. Features may change, be delayed or not be released. A purchase covers the features described as available at checkout, not a promise of future functionality.
3. Service access and early releases
Subject to these Terms and applicable feature licenses, we give you a limited, nonexclusive, nontransferable right to access and use the Service for your personal or business projects. Features, limits, supported platforms and availability depend on your account and the offer you accept. Access to the website does not by itself include downloads, exports, source code, API access or third-party integrations.
Alpha, beta, preview and experimental features may contain errors, produce unsuitable results, change or become unavailable. Testing may involve resets or loss of content, settings or complimentary credits. Keep your own copies where export is available and do not use an early release as the only copy of important work. We do not promise uninterrupted service or compatibility with every device, engine, DCC tool or external platform.
If you separately accept a Private Alpha Agreement, its confidentiality, sharing restrictions, grants and other alpha-specific terms continue to govern that participation and control over conflicting provisions here. These Terms and the public website do not lift an alpha embargo. Separate written enterprise agreements or feature-specific terms control their subject matter where they expressly differ from these Terms. Open-source components remain governed by their own licenses.
4. Your inputs and creations
"Inputs" are material you upload, submit or connect to the Service, including photos, recordings, text, prompts, code and assets. "Outputs" are characters, images, voices, animations, games, scenes, code and other results generated for you. Together, these are "Your Content."
You retain your rights in Inputs. As between you and Gameable, you own your original Outputs to the extent ownership rights exist, and we assign to you any rights we may have in those original Outputs. This does not transfer rights in our platform, software, models, existing characters, templates or other pre-existing or third-party materials. Their applicable licenses continue to apply, including any attribution, redistribution or open-source requirements.
Subject to those rights, licenses, your available features and any alpha restrictions, you may use your original Outputs commercially. We do not guarantee that an Output is unique, copyrightable, accurate or free of third-party rights. Other users may receive similar results. Review Outputs before using, publishing, distributing or relying on them. Owning an Output does not give you rights to someone else's likeness, voice, brand, copyrighted work or fictional character appearing in it.
5. Likeness, voices and permissions
You must have the rights, permissions and legal authority needed to submit Inputs and make your intended use of Outputs. This includes rights in the underlying photo, recording, music, code or other material, and any required consent from the person depicted or whose voice is used. Permission from a depicted person does not replace permission from a photographer or other rights holder, and a publicly available photo or recording is not automatically free to use.
Do not create or use a real person's character or cloned voice without the permissions required for that use. Do not falsely suggest that a person, brand or rights holder endorses, participates in or authorizes a creation. We may require evidence of permission and restrict disputed content while we investigate. Any voice verification or consent requirements presented by a feature also apply.
An adult submitting an identifiable person's likeness or voice must also meet any age, consent and content restrictions applicable to the feature. Where a feature permits content depicting a person under 18, you must have authorization from their parent or legal guardian, or be that parent or guardian, and obtain any other permission required by law. Parental permission does not override a feature's prohibition on minor voice cloning or other restricted uses. Do not submit or create material that sexualizes, exploits, endangers or unlawfully exposes a minor, including synthetic or fictional depictions of child sexual abuse.
6. Permission to operate the Service
You grant us a nonexclusive, worldwide, royalty-free license to host, store, copy, process, transform, transmit and display Your Content as reasonably needed to provide, maintain and secure the Service, generate requested Outputs, carry out your sharing choices and respond to support requests. We may give our hosting, AI and other service providers the permissions necessary to perform those services for us.
This license does not transfer ownership of Your Content or authorize us to use your private content in public marketing without separate permission. We do not use your private uploads or creations to train general-purpose AI models without a separate opt-in. Service providers that process Your Content for us do so under terms that limit their use of it to providing their service. Feedback and technical diagnostics may be used to improve the Service without repurposing private content as general training data.
Authorized personnel may review relevant content to investigate a support request, address abuse or security issues, or comply with law. This license ends when the relevant content is deleted from our systems, except as needed for lawful retention, processing deletion requests or carrying out separately granted permissions. Our Privacy Policy explains personal-information processing and deletion. These Terms do not replace any separate consent required for biometric or other sensitive-data processing.
7. Sharing, community content and exports
The visibility and permissions shown when you publish or share control how others can access your creation. Publicly shared content may be viewed and interacted with by others, including through a shared link. Only publish material you are authorized to share.
Sharing publicly lets others view and interact with your creation. It does not let them download, copy, clone or reuse it unless a feature expressly offers a reuse license and you choose it; any such license and what it permits will be shown before you confirm. Privacy rights, lawful takedowns and the rights of people depicted still apply.
Use community assets only within their stated licenses. You are responsible for your own published games, experiences, claims and interactions with users, including any notices, permissions and customer support required for your offering. Monetization, creator earnings and revenue sharing require the applicable program terms; merely publishing does not create a right to payment from us.
Exports, plugins and APIs are available only where enabled and under the applicable access conditions and licenses. Any permission to remove Gameable branding must be expressly included in your entitlement or authorized by us. Do not remove required branding, attribution or rights notices. Third-party licenses may require attribution even when Gameable branding is removable.
8. Acceptable use
Do not use the Service to:
- Break the law or infringe intellectual property, privacy, publicity or other rights.
- Create nonconsensual intimate imagery, child sexual abuse material, sexual exploitation, credible threats, targeted harassment or content intended to facilitate serious harm.
- Impersonate someone deceptively, commit fraud, distribute scams or send unauthorized bulk messages.
- Upload malware, steal credentials, access another person's data, disrupt the Service or evade security controls, account restrictions or usage limits.
- Extract private information, scrape the Service through unauthorized automated access, or use it to identify or track people unlawfully.
- Reverse engineer protected portions of the Service except as permitted by applicable law or an applicable open-source license, or use unauthorized access to obtain our nonpublic models, code or systems.
Use automation through supported interfaces and within published limits. Do not present an AI character as a real person communicating live when that would mislead people. Generated conversations and advice may be inaccurate and are not a substitute for qualified professional advice or emergency services.
We may investigate suspected violations, limit or remove content, and suspend or terminate access as described below. We may make reports required by law. We do not guarantee that every user creation or interaction has been reviewed or is appropriate for every audience.
9. Plans, credits and billing
Joining a waitlist, creating a free account or receiving a complimentary grant does not authorize charges. Before a purchase, we will disclose the price, applicable taxes, billing frequency, included features, usage rates and material limits. You must expressly authorize any subscription or usage-based billing. Payments may be processed by third-party payment providers.
If you choose an auto-renewing subscription, it renews for the disclosed billing period until you cancel. You can cancel through the billing controls or contact us for help. Cancellation stops future renewals; access ordinarily continues through the paid period unless you request otherwise or applicable law requires a different result. We provide required confirmations and renewal notices. We will disclose price changes before they take effect and obtain any consent required by law.
Credits are units for using the Service, not money, an investment or a promise of creator earnings. They are not transferable or redeemable for cash except where legally required or expressly offered. Credit consumption, grant conditions, rollover and any expiration will be disclosed with the relevant offer. Paid credits and complimentary grants may have different conditions; a new policy will not retroactively remove purchased rights contrary to the accepted offer or law.
Credits spent on a build that fails or stops before a usable result are returned to your balance automatically. Credits spent on completed results and fees for completed billing periods are not refundable except where the law or a specific offer says otherwise. If a result is affected by a fault on our side, contact us and we will redo it or restore the credits. Nothing here removes your right to dispute an unauthorized charge.
A voluntary downgrade or cancellation takes effect at the end of the current billing period. Your characters and content stay in your account; what changes is the monthly credits and the features the smaller plan includes, which we show before you confirm. Canceling stops future charges; nothing is deleted because you cancel. Any later change to what a plan includes will be announced in advance and will not retroactively remove rights you have already paid for.
10. Third-party services
You may choose to connect external accounts, API keys, engines or other services. You authorize the access needed for the integration you select and must comply with the applicable third-party terms and licenses. Your own provider account may incur separate charges and have its own privacy, training and retention settings. Disconnecting an integration does not necessarily delete content or cancel services in that account.
We do not control independently operated third-party services or guarantee their continued availability or compatibility. This does not limit our responsibilities for providers acting on our behalf or rights you have under applicable law.
11. Our rights and feedback
Gameable and its licensors retain rights in the Service, technology, trademarks and other materials not expressly assigned or licensed to you. No rights are granted by implication. You may identify Gameable truthfully, but may not imply a partnership or endorsement without permission.
You allow us to use suggestions and other voluntary feedback to develop and commercialize the Service without payment or attribution. This permission survives account closure but does not transfer your creations or override our privacy and content-use commitments.
12. Content complaints and appeals
Report suspected infringement, unauthorized likeness or voice use, abuse or other unlawful content to contact@gameable.com. Identify the content and its location, explain the concern and your authority to report it, and provide a way to contact you. You do not need an account to report a concern. We may request supporting information, restrict access during review and notify affected users when appropriate and legally permitted.
For copyright complaints, include identification of the protected work and disputed material, sufficient location information, your contact details and physical or electronic signature, a statement of good-faith belief that the use is not authorized by the rights holder, its agent or law, and a statement that your notice is accurate and, under penalty of perjury, that you are authorized to act for the rights holder. Our designated agent for copyright notices is AvatarOS Inc., contact@gameable.com, 3 Germay Dr, Unit 4 #2768, Wilmington, DE 19804, United States. We handle notices and any legally available counter-notification procedures under applicable law. We terminate accounts of repeat infringers in appropriate circumstances.
If you believe we removed content or restricted your account in error, email contact@gameable.com with the subject "Content appeal" and explain why. We will review the request, subject to legal and security constraints. We may share the information necessary to process a complaint or appeal with the affected parties as described in our Privacy Policy or required by law.
13. Suspension, termination and deletion
You may stop using the Service at any time and request account deletion through available controls or contact@gameable.com. Cancel active subscriptions if you want to stop renewal; an account deletion request will also stop future subscription renewals. Amounts already lawfully incurred remain payable.
We may restrict or terminate access for a material breach, nonpayment, security or safety risks, legal requirements, or discontinuation of the Service. Where reasonably practicable, we will explain the reason and allow you to resolve the issue or retrieve eligible content. We may act immediately when needed to protect people or systems, comply with law or address serious abuse. If we discontinue a paid service or terminate it without your breach, we will refund prepaid fees for the unused service and unusable purchased credits, except to the extent an alternative remedy is agreed or law requires more.
Account and content deletion follow our Privacy Policy and any applicable separate agreement. We cannot guarantee deletion of copies independently made by people with whom you chose to share content. Valid continuing licenses remain subject to their terms and applicable privacy and other rights. Ownership, accrued payment obligations, permitted continuing licenses, confidentiality obligations, feedback rights, liability provisions and dispute provisions survive as needed to give them effect.
14. Disclaimers and liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. AI OUTPUTS MAY BE INACCURATE, INCOMPLETE, UNEXPECTED OR SIMILAR TO OTHER CONTENT. WE DO NOT GUARANTEE A PARTICULAR CREATIVE RESULT, REVENUE, AUDIENCE OR BUSINESS OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEABLE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES OR DATA. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where liability cannot lawfully be limited, or other liability that cannot lawfully be excluded or limited. Nothing in these Terms waives mandatory consumer guarantees, privacy rights or statutory remedies. If local law prevents a limitation from applying, it applies only to the extent permitted.
15. Responsibility for third-party claims
To the extent permitted by law, you will indemnify Gameable and its personnel against third-party claims, damages and reasonable legal costs arising from your unlawful use of the Service, your material breach of these Terms, or Your Content infringing a third party's rights. This does not cover claims caused by our own breach, negligence or misconduct. We will give prompt notice, reasonable cooperation at your expense and a reasonable opportunity to participate in the defense. No settlement may impose an admission, nonmonetary obligation or payment on you without your consent, which must not be unreasonably withheld. This section applies to consumers only to the extent permitted by mandatory law.
16. Governing law and disputes
California law governs these Terms, excluding conflict-of-laws rules. Unless mandatory law provides otherwise, disputes will be brought in the state courts in Los Angeles County, California, or the federal courts in the Central District of California, and both parties consent to those courts. If you are a consumer elsewhere, mandatory protections and any right to bring proceedings in your local courts remain available. These Terms do not require arbitration or waive class-action rights.
You are welcome to contact contact@gameable.com first so we can try to resolve a concern. Doing so is not a condition of exercising statutory rights or seeking urgent relief.
17. Changes and general terms
We may update these Terms as the Service evolves. We will update the date and give notice of material changes through the Service or another appropriate channel, ordinarily at least 30 days before they take effect. Changes needed for legal, security or abuse-prevention reasons may take effect sooner, with notice as required. Changes will not retroactively alter accrued rights or existing disputes. We will request renewed acceptance when required; continued use does not substitute for legally required consent.
These Terms and any separately accepted applicable agreements form the agreement for their subject matter. Our Privacy Policy explains our handling of personal information and does not itself authorize unrelated marketing or sensitive-data processing. If a provision is unenforceable, the remainder continues in effect. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it in connection with a merger, reorganization or sale of the relevant business, subject to your rights under applicable law. No third party receives enforcement rights except as expressly stated or required by law.
